By accessing this website or purchasing from Designs by Nature Gems, you agree to be bound by these Terms & Conditions.

You agree to provide current, complete, and accurate purchase and account information. We reserve the right to refuse or cancel any order if fraud, unauthorized activity, or materially inaccurate information is suspected. Any refunds issued will comply with applicable laws.

2. Privacy & Data Protection

All personal and business information is handled in accordance with applicable privacy legislation, including GDPR where applicable.

3. Product Information

All jewelry is handcrafted.

Due to the natural characteristics of gemstones, variations in color, tone, inclusions, and shape are inherent and part of what makes each piece unique. These variations are not considered defects.

We strive to display product details accurately; however, slight differences may occur due to photography, lighting, or screen settings.

4. Returns & Exchanges

We accept returns and exchanges within fourteen (14) days of confirmed delivery, provided the jewelry is unworn, in original condition, and returned with original packaging.

We want you to love your piece. If something isn’t quite right, we are here to help.

If you are unsure about fit or chain length, we encourage you to contact us prior to placing your order. We are happy to guide you.

Customers are responsible for return shipping costs. Original shipping charges are non-refundable.

Final Sale Items

The following items are final sale and not eligible for return or exchange:

• Custom chain lengths
• Made-to-order designs

Natural Gemstone Disclaimer

Variations in gemstone color, tone, inclusions, and shape are inherent characteristics of natural gemstones and are not considered defects.

5. Warranty & Repairs

Our pieces are handcrafted and intended for everyday wear with care.

We offer:

• Complimentary repair within one (1) year of purchase for manufacturing defects
• Repair services beyond one year for a reasonable fee

Shipping costs for repair services are the responsibility of the customer unless otherwise agreed.

This policy does not cover:

• Normal wear and tear, including metal oxidation and natural changes in gemstone appearance over time
• Accidental damage
• Improper storage or misuse
 • Lost items

6. Custom Orders & Stone Sourcing

All custom orders must be paid in full prior to the commencement of production.

Due to the personalized nature of custom work, all custom orders are final sale. Once production has begun, no cancellations, refunds, or exchanges will be permitted.

Custom pieces are created specifically to the purchaser’s specifications and cannot be resold. For this reason, payments for custom production are non-refundable.

Stone Sourcing Fee

If a custom order requires sourcing a specific gemstone or material not currently in inventory, a standardized sourcing fee will apply.

• The sourcing fee must be paid prior to initiating the sourcing process
• The sourcing fee compensates for time, supplier coordination, research, and procurement efforts
• Sourcing fees are non-refundable, regardless of whether a suitable stone is successfully secured

If a suitable stone is sourced and approved, full production payment will be required before fabrication begins.

Designs by Nature Gems may separate sourcing and production payments into two stages at its discretion.

Production Timeline

Estimated production timelines will be communicated at the time of order and may vary depending on complexity and order volume.

Design specifications must be finalized prior to production. Changes requested after production begins may incur additional fees.

If a completed custom order is not claimed or accepted within five (5) business days of completion notification, Designs by Nature Gems reserves the right to retain full payment and release the piece for general sale.

7. Shipping

All orders must be paid in full prior to shipment.

Shipping address changes must be requested within two (2) business days of purchase. After this period, Designs by Nature Gems is not responsible for errors resulting from incorrect information provided at checkout.

Processing times are listed on individual product pages and may vary depending on order volume.

International customers are responsible for any duties, customs fees, VAT, or import taxes charged by their country.

8. Shipping Protection & Risk of Loss

Risk of loss transfers to the purchaser once the order has been handed to the shipping carrier.

At checkout, customers may have the option to purchase shipping protection coverage. Shipping protection provides coverage for loss or damage during transit, subject to the terms of the protection provider.

If shipping protection is selected, claims for lost or damaged packages will be handled in accordance with the protection provider’s policies.

If shipping protection is declined, Designs by Nature Gems is not responsible for loss or damage occurring after transfer to the shipping carrier. However, we will assist customers in filing a claim directly with the carrier where applicable.

Replacement or refund decisions remain at our discretion and may depend on carrier investigation results.

9. Limitation of Liability

To the maximum extent permitted by law, Designs by Nature Gems shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website.

Liability, if established, shall not exceed the purchase price of the item in question.

10. Intellectual Property & Trademark

“Designs by Nature”® is a registered trademark in the United States and Canada.

All content on this website, including product designs, jewelry designs, text, images, graphics, logos, branding elements, and layout, is the property of Designs by Nature Gems and is protected by trademark, copyright, and intellectual property laws.

No content may be copied, reproduced, distributed, modified, or used for commercial purposes without prior written consent.

Unauthorized use of our trademark, product designs, or imagery may result in legal action.

11. Governing Law

These Terms & Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

12. Modifications

We reserve the right to update or modify these Terms & Conditions at any time. Continued use of the website following any updates constitutes acceptance of those changes.
