Thank you for visiting Designs by Nature Gems Inc. ("we," "our," or "us"). This Privacy Policy explains how we collect, use, share and protect your personal information when you visit https://designsbynaturegems.com/ ("the Website"), shop with us, place a custom order, or contact our Toronto studio.
Information We Collect
We collect personal information that you choose to give us, such as:
- Your name, email address, phone number, and shipping and billing addresses when you place an order.
- Messages, photos and details you share when you contact us or request a custom piece, including photos of your own stones and the personal meaning or story behind your design.
- Your email address if you subscribe to our newsletter.
We also collect some information automatically when you use the Website:
- Analytics: the pages you visit, how long you stay, and similar usage information.
- Cookies and similar technologies, as described in our Cookies section.
Payment information is entered directly into Shopify's secure checkout. We never see or store your full card details.
How We Use Your Information
We use your information to:
- Process, make and ship your orders, including custom pieces.
- Reply to your questions and keep you updated about your order.
- Send you a photo of your finished custom piece to approve before it ships or is picked up.
- Send newsletters, marketing and promotions, if you have agreed to receive them. You can unsubscribe at any time.
- Maintain, personalize and improve the Website.
- Prevent fraud and meet our legal obligations.
Photos and personal stories you share for a custom piece are used only to design and make your piece. We will not share them publicly without your permission.
Use of AI Tools
We are a small studio, and we use trusted software tools, including AI tools, to help us run our business. For example, AI may help us draft replies to your messages, write product descriptions, or organize design notes for a custom piece. We also use AI to create some model and lifestyle images that show how our jewellery may look when worn. These images are made from our own product photos.
How we protect you:
- A member of our team reviews everything before it is sent to you or published. AI does not make decisions about your order, refund or custom design.
- We review the privacy terms of the AI tools we use, turn off model training wherever the tool allows it, and limit the personal information we share with them.
- We never enter payment card details into AI tools.
- We never upload your photos, your stones or your custom order details to AI image or video tools.
If you'd prefer that your messages or custom order details are handled without AI tools, just tell us and we'll respect that.
Sharing of Your Information
We do not sell or rent your personal information. We share it only with:
- Service providers who help us run our business, such as Shopify (our store and checkout), payment processors, shipping carriers, email and newsletter tools, analytics tools, and AI tools. They may access your information only as needed to provide their services and must keep it secure.
- Authorities, when required by law or to respond to a valid legal request.
- A buyer or successor, if our business is sold or merged. We will notify you if this happens.
- Anyone else, only with your consent.
Some of our service providers store or process information outside Canada, including in the United States. When this happens, your information may be subject to the laws of that country.
Data Retention
We keep your personal information only as long as we need it for the purposes in this policy, or as required by law (for example, tax and accounting records). Custom order photos and design notes are kept so we can help with repairs, alterations or future orders. You can ask us to delete them at any time.
Security
We take reasonable measures to protect your personal information. However, no method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security.

The Website may link to other websites. They have their own privacy policies, and we are not responsible for their content or practices.
Your Privacy Rights
Depending on where you live, including Canada, Quebec, the United Kingdom and the European Union, you may have the right to:
- Access the personal information we hold about you and receive a copy.
- Correct information that is inaccurate.
- Ask us to delete your information, unless we must keep it for legal reasons.

- Object to or restrict certain uses of your information.
To make a request, contact our Privacy Officer using the details below. We will respond within 30 days. You also have the right to file a complaint with the Office of the Privacy Commissioner of Canada, the Commission d'accès à l'information du Québec, or your local data protection authority.
Children's Privacy
The Website is not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.

We may update this Privacy Policy from time to time. We will post any changes on this page with a new "Last Updated" date.
